Terms of use

These terms cover the Listnik app for iPhone and iPad and the Listnik server it syncs with. Listnik is made by Ilya Voloshin ("I" below). By using Listnik you agree to them, and to Apple's Licensed Application End User License Agreement, which applies to every app from the App Store. Where the two differ, these terms add to Apple's; they don't take away rights your local law gives you. How Listnik handles your data is in the privacy policy.

Fair use of the service

Don't use Listnik for anything illegal, to store content that isn't yours to store, or to overload, probe or break the service. The API is for your own household, your assistants and your automations. I may limit, suspend or close an account that breaks these terms, and I'll tell you why unless the law says I can't.

If you believe something stored in Listnik infringes your copyright, send a notice to my designated agent below. Under the U.S. Digital Millennium Copyright Act (17 U.S.C. §512(c)(3)), it needs:

  1. your physical or electronic signature;
  2. what copyrighted work you believe is infringed;
  3. what you believe infringes it, with enough detail to find it: the image or the page it came from (its address) is best;
  4. your address, phone number and email address;
  5. a statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for them.

I remove what a valid notice identifies, from every household that saved it, and tell the people affected where I can. If your content was removed and you believe it was a mistake or misidentification, you can send a counter-notice with your signature, what was removed, a statement under penalty of perjury that you believe it was removed by mistake, and your name, address and phone number with your consent to the jurisdiction of the federal court for your district. I'll pass it on to the person who sent the notice, and restore the content after 10 to 14 business days unless they tell me they've gone to court. Accounts that repeatedly infringe are closed.

The service itself

I work to keep Listnik running and your data safe (it's backed up every night), but it's provided as is, without guarantees that it will always be available or free of errors. Features can change. If I ever stop running Listnik, I'll say so in the app at least 60 days before, and stop selling and renewing Listnik Plus. To the extent the law allows, I'm not liable for indirect or consequential losses, and my total liability is limited to what you paid for Listnik Plus in the previous 12 months.

Changes

If these terms change in a way that matters, I'll update the date above and say so in the app before the change takes effect. Continuing to use Listnik after that means you accept the new terms.
